Jay’s Autoservice believes the protection of personal data is essential. We therefore process your data with the utmost care. With this privacy statement we inform you about how we handle personal data.

1. Who is responsible for processing your data?

In this privacy statement, Jay’s Autoservice (hereinafter “Jay’s Autoservice” or “we”) describes how it handles your personal data as a data controller.

2. What is personal data?

Information about an identified or identifiable natural person is personal data. Whether certain information qualifies as personal data depends in part on whether Jay’s Autoservice has legitimate means that it can reasonably be expected to use to identify a data subject. For example, we also consider your license plate number and chassis number to be personal data.

3. Personal data we process.

We process personal data about you because you provide data to us yourself when entering into a contract with us, but also when you use our services and thereby provide us with data, or enable us to record data about your interests and preferences.

Information provided to us

If you enter into an agreement with Jay’s Autoservice Nederland, we need the following personal data from you:

  • name and address;
  • contact information (phone numbers, e-mail addresses);
  • date of birth;
  • sex;
  • customer number(s);
  • payment information (bank account information, quotes, invoices)

In addition, in the context of executing an agreement with you or providing a service to you, we process the following data that may qualify as personal data:

  • chassis number and model of your vehicle;
  • technical data about your vehicle;
  • license plate number of your vehicle;
  • maintenance history of your vehicle;
  • Ownership history of your vehicle (registration information);
  • Other data relevant to the agreement in question.

Data about your use of our services and/or products

If you use services of Jay’s Autoservice or otherwise have contact with us, we process in the context of our services – depending on the exact use you make of them – the following data that (may) be considered personal data:

  • data related to your peripheral devices, such as a MAC address, IP address or other number;
  • Your communication preferences and settings;
  • data we associate with certain patterns, such as a status in the profile we create about you based on your consumption behavior (for example: the frequency with which you make a purchase or purchase a service);
  • surfing behavior, determined from our own observations or cookies (see also Article 9 of this privacy statement);
  • customer satisfaction data.

4. No processing of data of persons under 16 years of age

We do not intend to collect data from website visitors under 16 years of age. We encourage parents to be involved in their children’s online activities in order to prevent Jay’s Autoservice from processing their personal data.

5. Processing: bases and legitimate interests

The processing of personal data takes place on the following bases from Article 6 of the General Data Protection Regulation:

  1. Permission
  2. Execution of an agreement with you
  3. Legal obligation
  4. Performance of a public interest task
  5. Legitimate interest of Jay’s Autoservice or a third party

Justified interests include marketing, advertising, security, (crime) prevention, IT management, research and analysis of own products or services, corporate governance, legal affairs, internal management.

6. Purposes of processing personal data

Jay’s Autoservice processes your personal data for the purposes listed below. The number after each purpose corresponds to the basis mentioned in Article 5 of this privacy statement.

– Establish and maintain customer relationships including maintaining a direct relationship between the responsible party and related financial service providers, including for commercial purposes [basis: 2, 5].

– Order fulfillment (including billing), processing in financial records and logistical handling [basis: 2, 5].

– Providing customer service including service around buying services and products, fulfilling warranty obligations and product recalls for our own services, handling complaints and requests [base: 2, 3, 4 or 5].

– Maintaining communications in certain instances to proactively contact users in the context of vehicle defects or malfunctions or to schedule service appointments including enabling mobility services [base: 2 of 5].

– Conducting market research to improve our business, brands, services and products [basis: 5].

– Communicating with stakeholders and providing a loyalty program [base: 1 of 5].

– Approaching you with offers or other commercial information. In doing so, you always have the option to opt out of this by objecting. All communications indicate how to do this [base: 1 or 5].

– Improving the content of our communications by tailoring them to your personal preferences [basis: 5].

– To (further) develop and improve new and existing products and services [basis: 5].

– Measuring customer satisfaction, providing management information and determining overall business strategy [base: 1 of 5].

– Organizing events for data analysis purposes in order to improve or develop products or services, where participants of these events work with personal data in (pseudo) anonymous form – not directly traceable to you as a natural person-, to the extent permitted under applicable law [basis: 5].

  • Providing services on the Internet and through app functionalities, including providing relevant commercial messages in these apps [basis: 1, 2 or 5].
  • Compliance with legal obligations, dispute resolution and enforcement of our rights and agreements [Basis: 3, 4 or 5].
  • Improving data quality using address validation techniques [foundation: 5].
  • Linking and analyzing cookies from our websites to customer data known to us. We do this to best tailor the content of our communications to your personal preferences [base: 1 of 5].
  • Being able to offer a test drive or otherwise make a vehicle temporarily available. In doing so, we may ask you to identify yourself with valid identification and/or when necessary we will make a protected copy of your driver’s license or ID card/passport for the duration of the use of the vehicle. We do this to establish your identity and to enable you to file a report when theft is suspected or there is evidence of damage or misconduct. [basis: 2].

7. Sharing with third parties

Jay’s Autoservice shares your personal data with third parties in the following cases and for corresponding reasons, among others. The number after each purpose corresponds to the basis mentioned in Article 5 of this privacy statement:

– with affiliated financial service providers for the purpose of offering connecting financial services [foundation: 2];

– with authorized dealers or service partners from Jay’s Autoservice’s distribution network [base: 1, 2 or 5];

– If we are required or authorized by law to provide personal data to third parties [basis: 3];

– if we suspect a violation of third-party rights, criminal offenses or abuse, we may provide personal data to third parties who have a legitimate interest in doing so or to bodies that serve the public interest. These may include enforcement authorities such as the Public Prosecutor’s Office or supervisors [basis: 3, 4 or 5];

– Jay’s Autoservice may also share your information with other business units within Jay’s Autoservice for the performance of an agreement with you, or because of legitimate business interests, such as maintaining centralized administration or customer service, and analyzing our services to you [basis: 5].

– with parties that assist Jay’s Autoservice in its services and are not processors (think accountants and (legal) consultants) [basis: 5];

– For business purposes (such as the sale of business operations or shares or a reorganization) [basis: 5].

Jay’s Autoservice also uses third-party services that act as “processors” (e.g., hosting service providers, mobility service providers and research firms, for the purpose of conducting market research or customer satisfaction surveys. These service providers will process personal data only in accordance with the instructions and under the control of Jay’s Autoservice

If personal data is sent to a recipient abroad, it is usually only sent to a recipient in a country that the European Commission considers to provide an adequate level of protection for personal data. If personal data is sent to a recipient in a country that does not provide an adequate level of protection, then

Jay’s Autoservice ensure that legally required safeguards are taken. If you wish to receive further information regarding the transfer of your personal data to countries outside the European Economic Area, please contact Jay’s Autoservice’s Data Protection Officer (see article 12).

8. How long we keep data

We retain personal data in accordance with our internal data retention policy and/or for as long as (i) you are a customer of Jay’s Autoservice or continue to express interest in Jay’s Autoservice services, (ii) we are required by law to retain data, or (iii) we believe we have good reason to retain data as necessary.

9. Mapping website traffic

When you visit or use our websites, services, applications, communications services (such as e-mail) and tools, we may use cookies, web beacons and other similar information-storage technologies for the purpose of personalizing advertising and providing you with a better, faster and safer customer experience. 10. Your rights, including the right to object

You have the right to know what personal data we have recorded about you and to whom we have provided your personal data. For this you can contact us through customer service. Jay’s Autoservice will make every effort to respond within the legal deadline. We may disregard excessive requests.

In addition to the right to inspect, you have the following rights with respect to our processing of your personal data:

  • The right to withdraw your consent, to the extent that our processing of your personal data is based on it;
  • The right to file a complaint with the Personal Data Authority;
  • The right to (have) your personal data rectified/corrected;
  • The right to have your personal data deleted;
  • The right to restrict the processing concerning you;
  • the right to data portability;
  • The absolute right to object to direct marketing;
  • The right to object to processing carried out due to the legitimate interests of Jay’s Autoservice or a third party (depending on your personal circumstances).

    You can only exercise your rights to the extent that the law grants you these rights. To ensure that the request for access is made by you yourself, we ask that you enclose a copy of your proof of identity with this request. In doing so, we also ask that the passport photo, MRZ (machine readable zone; the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN) be made unrecognizable on this copy.

11. Security and protection of data

Jay’s Autoservice applies appropriate security measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized modification as much as possible. Jay’s Autoservice has taken both technical and organizational measures to secure your personal data. These security measures are reviewed periodically based on threats.
